Doug Greenwalt and Roy Greenwalt, defendants and respondents, were charged with the crime of theft, a felony. A jury trial was held on September 22-25, 1981, in the Thirteenth Page 198 Judicial District Court, Big Horn County. On September 24, 1981, the District Court dismissed that part of the information involving the theft of a calf belonging to Nelvett Siemion, an enrolled member of the Crow Tribe. On September 25, 1981, the State, having presented all its evidence, rested, whereupon defendants moved to dismiss the remaining charges for insufficient evidence. The District Court granted defendants motion, and the jury was dismissed. The State appeals.
